1. What skrivant is
skrivant is a web service that helps you draft long-form fiction using AI, available at skrivant.com. By “the Service,” we mean the skrivant website, tools, and anything you can do with your account at skrivant.com (and scrivant.com, which redirects to skrivant.com).
The Service is operated by Nondeterministic Technologies LLC, a Texas limited liability company based in Denton County, Texas. References to “we,” “us,” and “our” mean Nondeterministic Technologies LLC. You can reach us at help@skrivant.com for general questions, or legal@skrivant.com for legal and privacy matters.
2. Who can use skrivant
You must be 18 years or older to use skrivant. By using the Service, you confirm that you are 18 or older. If we learn you are under 18, we will terminate your account.
skrivant is open to the public. You can create an account by signing up at skrivant.com, for example with Google sign-in or your email address. No invitation is required.
3. Your account
When you create an account, you agree to give accurate information, keep your password (if applicable) secure, and tell us promptly if your account is compromised. You are responsible for activity that happens under your account.
One person, one account. Don't share accounts, and don't create multiple accounts to get around limits.
4. How you can use the Service
You can use skrivant to draft fiction for your own purposes, including fiction you intend to publish. You are responsible for what you do with anything skrivant helps you create.
You agree not to use skrivant to write, generate, or otherwise create:
- Content involving the sexual exploitation or abuse of minors. This is an absolute prohibition and will result in immediate termination. We may report violations to authorities as required by law.
- Content intended to harass, defame, or impersonate a specific real person.
- Content that promotes or facilitates violence, illegal acts, weapons creation, or self-harm.
- Content that violates someone else's copyright, trademark, or other intellectual property rights.
- Deceptive content intended to mislead others about its origin or authorship (beyond ordinary fiction).
You also agree not to:
- Attempt to reverse-engineer, scrape, or extract the underlying prompts, models, or infrastructure.
- Use the Service to train competing AI models.
- Do anything illegal under United States law or the law of your jurisdiction.
Because skrivant generates drafts using DeepSeek's AI models, you also agree to follow DeepSeek's terms of use and acceptable use rules (DeepSeek Terms of Use). If DeepSeek's policies change, you agree to comply with the updated version. If we change AI providers in the future, you agree to comply with the new provider's usage policies in the same way; we will update this document to reflect the change.
We may review content on the Service to enforce these rules, respond to reports, or comply with law. We do not review content for quality or to make editorial suggestions.
5. Your content
Your prompts, inputs, and the content you write, generate, upload, or otherwise create through the Service are yours. We claim no ownership over them.
To operate the Service, you grant us a limited license to store, process, and display your content to you, and to transmit your inputs to our AI provider for generation. This license exists only so we can run the Service and ends when you delete your content or your account.
On copyright: You own your inputs and generated content as between you and us. However, copyright law regarding AI-assisted works is evolving, particularly in the United States. We make no representation that AI-generated content is eligible for copyright protection. The U.S. Copyright Office currently takes the position that purely AI-generated content is not copyrightable, and that works with AI assistance must meet a human-authorship threshold to qualify. This area of law is evolving and may change.
skrivant maintains a record of the prompts, edits, and decisions you make while drafting. If you need this record to support a copyright registration or other authorship claim, contact us at legal@skrivant.com and we will provide it. We make no representation that this record will be sufficient for any particular purpose.
Whether any content you create through skrivant meets the human-authorship threshold depends on facts we can't determine. Consult an attorney for publication and copyright questions.
You are responsible for the content you create through skrivant and for what you do with it. If your prompts or outputs infringe someone else's rights, you are responsible, not us.
6. Pricing and payment
skrivant charges a one-time price for each book you generate. The price is shown before you pay. We can change prices and availability at any time; any change applies to purchases made after the change takes effect.
[PLACEHOLDER: refund policy pending. Replace this sentence with the finalized refund terms before launch.]
7. Service changes, availability, and termination
skrivant is in active development. Features may change or be removed. The Service may be unavailable, slow, or produce errors. We make no uptime guarantees.
We can terminate or suspend your access at any time, with or without notice, for any reason, including violation of these terms.
If we terminate your account for reasons other than your violation of these Terms, we will make a reasonable effort to provide you a copy of your content before deletion. If we terminate for violation of these Terms, we may delete your content immediately. In either case, we recommend exporting and backing up anything important.
You can stop using skrivant at any time and can request deletion of your account and associated content by emailing legal@skrivant.com. See the Privacy Policy for what happens to your data.
8. AI-generated content: no warranty on quality or accuracy
skrivant uses AI to generate content. AI output is probabilistic and can be inaccurate, inconsistent, inappropriate, or similar to existing works. We do not guarantee that generated content will be:
- Original or non-infringing
- Factually accurate
- Suitable for any particular purpose
- Consistent across generations
- Free of bias, offensive content, or errors
You review and edit what skrivant produces before relying on it, publishing it, or sharing it with anyone else. Using skrivant's output without review is at your own risk.
9. Disclaimer and limitation of liability
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of:
- Your use of the Service
- Your violation of these Terms
- Your infringement of someone else's rights, including intellectual property rights
- Content you create or publish using the Service
11. Governing law, venue, and jury waiver
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively in the state and federal courts located in Denton County, Texas. You and we consent to the personal jurisdiction of those courts and waive any objection to venue.
Each party waives any right to a jury trial in any proceeding arising out of or relating to these Terms or the Service.
You and we agree that any claim must be brought within one (1) year after the cause of action accrues, or it is permanently barred.
12. Copyright complaints (DMCA)
If you believe content on skrivant infringes your copyright, email legal@skrivant.com with:
- A description of the copyrighted work
- A description of where the allegedly infringing content appears on skrivant
- Your contact information
- A statement that you have a good-faith belief the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act
- Your physical or electronic signature
We will respond to valid notices and may remove content and terminate accounts of repeat infringers.
13. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you by email and update the “Last updated” date at the top. Continued use of the Service after changes take effect means you accept the updated Terms. If you don't accept them, stop using the Service and request account deletion.
14. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the complete agreement between you and us about the Service.
- Severability. If a court finds any part of these Terms unenforceable, the rest stays in effect.
- No waiver. If we don't enforce a provision, that doesn't waive our right to enforce it later.
- Assignment. You can't assign these Terms. We can assign them to a successor entity (for example, in connection with a merger, acquisition, or reorganization).
- No agency. Using skrivant doesn't make you our employee, partner, or agent.
